The basis for the work of the Tyrolean Regional Parliament is explained in the preamble to the Tyrol state constitution. This recognises the loyalty to God and to our historical inheritance, the intellectual and cultural unity of the whole state, human freedoms and dignity and the ordered family as the basic building block of the people and the state as the intellectual, political and social base of the Tyrol.
It is the highest duty of the state legislature and authorities to maintain and protect this fundamental principle.
The Tyrolean Regional Parliament is always inspired to ensure that the Tyrol remains a state where freedom, democracy, respect and understanding for our neighbours forms the basis of our common existence.
The members of the Parliament are elected every five years on the basis of an equal, immediate, secret and individual system of proportional representation. And they are not subject to a binding mandate (principle of the independent mandate) but are responsible only to the legal system and their own conscience. Moreover, the members are protected by legal immunity. This means that members can never be held to account for their voting record and can only be made responsible by the Tyrolean Regional Parliament (state legislature) for oral or written comments in the performance of their duties. Also they are only open to criminal prosecution under certain circumstances.
At its initial meeting (constitutive meeting) the Tyrolean Regional Parliament elects the president and two vice-presidents. After he has born sworn in, the newly elected president takes the chair and carries out the election of the state government (state governor, two deputy state governors and a maximum of five members of the state government) as well as the five members and reserve members of the federal council from the Tyrol state.
Before taking up his office the state governor has to swear to the president of the Tyrolean Regional Parliament that he will respect the state constitution, federal laws and other state laws and that he will fulfill his duties conscientiously.
In addition to its main role as the state legislature the Parliament also exercises a control function over the state government.
For the Tyrolean Regional Parliament the state audit office and the state ombudsman office as well as the state administrative office are assigned as offices of state.
