Information on approval to operate a general or specialised ski school

General information Explanation of this section

A ski school permit is required for the operation of a ski school/divisional ski school.

Requirements Explanation of this section

·        Age of legal majority and corresponding decision-making capacity

·        Status as a beneficiary (EU, EEA, Switzerland and nationals and persons treated as persons on the basis of contracts in the framework of European integration),

·        Reliability, physical and mental aptitude, and qualification to work in the field

·        Liability insurance cover of at least EUR 6 million

·        Suitable ski school office and assembly point (unless operating without teachers)

·        For native speakers of a foreign language, the absolutely necessary knowledge of the German language

·        No existing approval for a ski school in Tyrol

·        Name of the ski school (Tiroler Schischule or Tiroler Skischule, except when operating without teachers, a place name referring to the location of the ski school, and the surname and first name of the proprietor of the ski school; for specialised ski schools, a reference to the specialisation(s) for which they have approval)

 

If no recognition process for vocational qualifications takes place, qualification to work in the field must be demonstrated by means of a certificate showing a pass in

 

·        the ski instructor’s diploma examination, ski guide’s examination, snowboard instructor’s examination, cross-country ski instructor’s examination and entrepreneur’s examination and at least 25 weeks’ work as a certified ski instructor at a domestic ski school or federal sports institute, for the operation of a general ski school,

·        the ski instructor’s diploma examination, ski guide’s examination and entrepreneur’s examination and at least 25 weeks’ work as a certified ski instructor at a domestic ski school or federal sports institute, for the operation of a specialised ski school approved for Alpine skiing,

·        the snowboard instructor’s diploma examination, snowboard guide’s examination and entrepreneur’s examination and at least 25 weeks’ work as a certified snowboard instructor at a domestic ski school or federal sports institute, for the operation of a specialised ski school approved for snowboarding,

·        the ski instructor’s diploma examination, ski guide’s examination, snowboard instructor’s examination and entrepreneur’s examination and at least 25 weeks’ work as a certified ski instructor at a domestic ski school or federal sports institute, for the operation of a specialised ski school approved for Alpine skiing and snowboarding,

·        the cross-country ski instructor’s diploma examination and entrepreneur’s examination and at least 25 weeks’ work as a certified cross-country ski instructor at a domestic ski school or federal sports institute, for the operation of a specialised ski school approved for cross-country skiing,

·        the snowboard instructor’s diploma examination, snowboard guide’s examination, cross-country ski instructor’s examination and entrepreneur’s examination and at least 25 weeks’ work as a certified snowboard instructor at a domestic ski school or federal sports institute, for the operation of a specialised ski school approved for snowboarding and cross-country skiing,

·        the ski instructor’s diploma examination, ski guide’s examination cross-country ski instructor’s examination and entrepreneur’s examination and at least 25 weeks’ work as a certified ski instructor at a domestic ski school or federal sports institute, for the operation of a specialised ski school approved for Alpine and cross-country skiing,

·        and, for the operation of a specialised ski school approved for skiing for people with disabilities and limited to one or more specific types of skiing, certificates and/or practical experience corresponding to the type of skiing in question and completion of a relevant continuing vocational training or upskilling programme.

 

If any of the examinations, with the exception of the entrepreneur’s examination, was taken more than five years prior to the submission of the application, proof of participation in a relevant training event must also be provided.

The requirement of relevant work as a certified ski, snowboard or cross-country ski instructor and of participation in training events is waived if the applicant holds a recognised qualification to work in the field under the Tiroler EU-Berufsangelegenheiten-Gesetz (Tyrolean EU Vocational Affairs Act) and provides evidence of the professional experience and training required by the law of the State concerned for the operation of a ski school.

Deadlines Explanation of this section

None. The work may only be carried out once the permit has been legally issued.

 

Processing time

The district administrative authorities are obliged to decide on any complete application without undue delay and within 6 months at the latest by issuing an administrative decision in writing.


Procedure Explanation of this section

An application for approval of a ski school must be submitted in writing. The documents to be included must be no more than three months old at the time of submission of the application. A decision on the application must be issued in writing in the form of an administrative decision.

At the same time as the award decision, the district administrative authority issues the ski school proprietor’s permit.

The ski school permit becomes void upon the death of the holder or the revocation or relinquishment of the permit.

·        Proof of citizenship

·        Proof of status as a beneficiary (EU, EEA, Switzerland and citizens of other States assimilated under treaties relating to European integration)

·        Confirmation of residence registration

·        Extract from the judicial record or equivalent for non-Austrian citizens (no more than three months old)

·        Medical certificate of physical and mental aptitude (no more than three months old)

·        Certificate from an accredited insurance provider confirming that the minimum amount of civil liability insurance is in place (no more than three months old)

·        Plan of the location and size of the ski school office and the assembly point and the right to use it (unless operating without teachers)

·        Certificates or recognition decisions in the context of European integration relating to relevant ski instructor training, depending on the scope of the ski school approval (see the requirements for qualification to work in the field).

 

Type and format of evidence to be provided

The photograph for the professional ID card must have dimensions of 3.5 x 4.5 cm (= standard passport photo) or at least 600 x 800 pixels (as a digital image). The image quality should be in line with the criteria for passports: http://www.passbildkriterien.at/oesterreich.html

Costs Explanation of this section

According to the 1957 Gebührengesetz (Fees Act):

·        submission fee EUR 47.30, appended documents EUR 3.90, up to a maximum of EUR 21.80; fees in the event of electronic submission using a citizen card: submission fee EUR 28.40, appended documents EUR 2.30, up to a maximum of EUR 13.10

·        award decision: EUR 83.60

 

According to the 2007 Landes-Verwaltungsabgabenverordnung (Provincial Administrative Charges Ordinance):

·      Approval to operate a general ski school EUR 110.00

·      Approval to operate a specialised ski school EUR 80.00

 

The costs incurred can be paid electronically by bank transfer once the applicant has been notified of the administrative decision.

It is not mandatory to sign the application either electronically (using the Handy-Signatur app or e ID) or by hand.

Legal remedies

Appeals against administrative decisions by the district administrative authorities can be brought before the provincial administrative court. Any appeal must specify the contested administrative decision and the authority that issued it. It must contain a request and set out the grounds on which the allegation of unlawfulness is based. The appeal must be submitted in writing, within 4 weeks of notification of the administrative decision, to the district administrative authority which issued that decision and must contain information that makes it possible to assess its timeliness. The district administrative authority can issue a preliminary decision on the appeal. The appeal can be submitted electronically: Beschwerde im Verwaltungsverfahren (portal for appeals within the administrative procedure).

If the administrative authority fails to make a decision within 6 months, you have the option of filing a complaint with the administrative authority regarding the delay. This must be filed with the district administrative authority found to be in default. The complaint must specify that authority, set out a specific request and demonstrate that the authority’s time-limit for taking a decision has expired.
