Description

The operation of a private vocational or technical school must be notified to the provincial government at least 3 months before the intended opening with proof of fulfilment of the legal requirements. At the same time as the notification of the intended operation of a private vocational or technical school, the education provider must also indicate the name of the school. Furthermore, the provincial government must be notified of the appointment of the director and of the teachers.

The operation of a private vocational or technical school must be notified to the provincial government at least 3 months before the intended opening with proof of fulfilment of the legal requirements. At the same time as the notification of the intended operation of a private vocational or technical school, the education provider must also indicate the name of the school. Furthermore, the provincial government must be notified of the appointment of the director and of the teachers.

Requirements Explanation of this section

Unless otherwise stipulated by law, private vocational and technical schools are generally open to all students. The following are authorised to manage a private vocational or technical school:

a) natural persons with full legal capacity and who are trustworthy;

b) legal persons whose authorised representative bodies have full legal capacity and are trustworthy;

c) public-law bodies, legally recognised churches and religious societies and their institutions.

Appointment of the director and teachers:

(1) For the educational and administrative management of a private vocational or technical school, the education provider must appoint a director:

a) who is ethically and physically fit to practise as a teacher;

b) who has a teaching qualification for the relevant or a related type of school; and

c) for whom there are no circumstances that could be expected to have a negative impact on the agricultural and forestry school system.

(2) An education provider who fulfils the requirements set out in paragraph 1(a) to (c) may also be the director of a private vocational or technical school.

(3) The school provider may only employ teachers in a private vocational or technical school who fulfil the requirements specified in paragraph 1(a) and (b) and who have the teaching qualification for the relevant or a related type of school or another suitable qualification.

Tasks of the school provider:

(1) The school provider is responsible for financial and staffing provisions for the operation of a private vocational or technical school. Furthermore, the school provider must provide the necessary school buildings, classrooms and other school facilities, the structural design and furnishing of which must meet the requirements for the protection of the life and health of the pupils and staff, as well as the necessary teaching materials and facilities for the provision of first aid.

(2) The school provider must refrain from exerting any influence on the duties incumbent on the director of a private vocational or technical school under this Act, unless the school provider is the director, and on the teachers.

The operation of a private vocational or technical school must be notified to the provincial government at least 3 months before the intended opening with proof of fulfilment of the legal requirements. If the legal requirements are not met, the provincial government will prohibit the operation of the private vocational or technical school within 2 months of receipt of the notification. If the operation of the private vocational or technical school is not prohibited within this period, the school may be opened.
