Notification requirement in the event of significant prejudice to the requirements under Section 3 of the Tyrol Organised Events Act (Tiroler Veranstaltungsgesetz) 2003

General information Explanation of this section

Under Section 25 of the Tyrol Organised Events Act 2003, the organiser must immediately inform the municipality (and the supervisory authority if this authority is not the municipality) of organised events for which experience shows that prejudice to the requirements under Section 3 of the aforementioned Act cannot be ruled out. Requirements: Public events must be conducted in such a way, and the facilities used for that purpose must in their entirety be designed, created, constructed, installed, modified, operated, maintained and repaired in such a way, as to:

a) correspond to the state of the art, in particular to building, safety, fire-safety and hygiene requirements;

b) endanger neither the life or health of people nor the safety of property;

c) cause no unacceptable nuisance to people through noise, smell, smoke, shaking, heat, light or vibrations or in any other way;

d) create no expectation of any disturbance of public peace, order and safety or of harm to other public interests, particularly those pertaining to the protection of minors;

e) not significantly affect the character of the location, the landscape or the environment.

Note on Jurisdiction

- responsibility of the mayor of the municipality in which the event is to be held, or the city administration if in the city of Innsbruck;

- if the event extends across the territory of several municipalities of a political district, the district authority is the competent authority;

- if the event extends across the territory of several political districts, the provincial government is the competent authority.
