Information on nature conservation legislation regarding the construction, installation, mounting or modification of advertising equipment.

General information Explanation of this section

Unless otherwise stipulated in the exceptions in paragraph 2 (for more details see ‘Further Information’), nature conservation authorisation is required for the construction, installation, mounting or modification of advertising equipment outside built-up areas (Section 15(1) Tyrolean Nature Conservation Act 2005 [TNSchG 2005]).

Requirements Explanation of this section

No damage to nature conservation interests pursuant to Section 1(1) TNSchG 2005 due to the material type, size, shape, colour, light effect or other similar properties of the advertising equipment.

Deadlines Explanation of this section

None. The project may not be started until a legally binding authorisation has been issued.

The authority must issue a decision on a complete application without undue delay, and in any case within 6 months.

Written application – check of completeness of documents – investigation procedure (expert’s report, on-site inspection, discussion) – decision.

Required documents Explanation of this section

In duplicate:

-      written application;

-      project description (project type, location and scope, with location and an orthophoto montage if possible);

-      description of the natural history of the site(s);

-      information on alternative solutions;

-      declarations of consent from affected landowners or proof of ownership.

Costs Explanation of this section

-      Administrative charge if authorisation is approved: EUR 220; if authorisation is rejected: nothing;

-      Fees: application fee: EUR 14.30, appendices: EUR 3.90, max. EUR 21.80 per appendix;

-      Other costs.

The costs due must be paid following notification thereof.

Note on Jurisdiction

If a project extends to the territory of several districts or if, in addition to authorisation under nature conservation law, it requires authorisation under:

a) a provision of federal law for whose issuance the federal government, a federal minister or the governor of a province is responsible; or

b) another provincial legal provision for which the provincial government is responsible, 

the Tyrolean Provincial Government is the competent authority.

Details

Authentification and signature

The application does not have to be signed electronically – using a mobile phone signature (Handy-Signatur) or E-ID – or by hand. 

Additional information Explanation of this section

NO nature conservation authorisation is required for the construction, installation, mounting or modification of:

a)   advertising equipment on buildings with living areas;

b)   legally required business and establishment names and advertising equipment directly connected with them, if the advertising equipment is located on buildings or on the same property as the business or industrial building;

c)    advertising equipment that complies with the requirements set out under paragraph 3 of this Regulation (https://www.ris.bka.gv.at/GeltendeFassung.wxe?Abfrage=LrT&Gesetzesnummer=10000250);

d)   information about temporary events, provided that they are constructed, set up or affixed within 6 weeks of the start of the event. They must be removed no later than 2 weeks after the end of the event;

e)   installations to display posters by groups canvassing for elections for the European Parliament, the Federal President, a general representative body or the governing bodies of a statutory professional representation or advertising for a referendum, a popular consultation or a petition for a referendum under provincial or federal law or for a European citizens' initiative, provided that it is carried out within 6 weeks prior to and on the day of the election, referendum, popular consultation or the start of the registration period. Such installations must be removed by the group concerned no later than 2 weeks after the day of the election, referendum or popular consultation or the end of the registration period;

f)     advertising equipment that, on the basis of a decision pursuant to paragraph 4 and in accordance with any conditions stipulated within it, are not expected to damage nature conservation interests pursuant to Section 1(1) (see https://www.tirol.gv.at/umwelt/umweltrecht/na10/);

g)   advertising equipment for indoor advertising in sports facilities, provided that they are neither self-luminous nor illuminated.

Legal remedies

Appeals against decisions of the competent authority may be lodged with the Provincial Administrative Court (Landesverwaltungsgericht). The appeal must specify the contested decision and the authority that issued it. It must contain a request and set out the grounds on which the allegation of illegality is based. The appeal must be submitted in writing to the authority that issued the decision within 4 weeks of notification of this decision, and must contain information that makes it possible to assess its timeliness. The authority may issue a preliminary appeal decision. The appeal may be filed electronically: Beschwerde im Verwaltungsverfahren (Appeals in administrative proceedings).

If the administrative authority fails to make a decision within 6 months, you have the option of filing a complaint before the Regional Administrative Court regarding the delay. This must be filed with the defaulting authority. The complaint must specify that authority, set out a specific request and demonstrate that the authority’s time limit for making a decision has expired.
