Information on authorisation to carry out the commercial activity of betting operator

General information Explanation of this section

Required for commercial conclusion and placing of bets on the occasion of sporting events. The recognition of the professional qualification to carry out the activity of betting operator in the context of European integration and the European Professional Card (Tyrol Law on Recognition of EU Professional Qualifications – Tiroler EU-Berufs Qualifications-Anerkennungsgesetz) replaces the attestation of competence required in the authorisation procedure.

Note: once the recognition procedure has been completed, a further procedure is required for the activity to be carried out.

Requirements Explanation of this section

Application to the Office of the Tyrol Provincial Government; the activity must not be carried out on a temporary or occasional basis within the meaning of the provision of cross-border services.

Deadlines Explanation of this section

The activity may be pursued only after the legal authorisation to carry out the activity of betting operator has been issued.

Procedure Explanation of this section

The application, together with the necessary documents, must be submitted in writing.

The application must contain at least the following details:

a) name of the applicant;

b) address for service;

c) breakdown of periods of work (as a self-employed person, head of a company/branch, deputy of a company/manager, in a senior position or as a dependent worker / employee, in connection with sports betting);

d) attestations of competence and evidence of formal qualifications.

Review of the application; issue of the decision recognising the professional qualification; application for issue of an authorisation to carry out the activity of betting operator; authorisation decision.

Required documents Explanation of this section

Proof of nationality (European Union citizens or family members of European Union citizens or of nationals of other contracting states to the EEA Agreement, and Swiss citizens), or being their family member beneficiaries.

Original criminal record extract or document issued by a competent judicial or administrative authority in the home country or State of origin covering any criminal convictions (not more than 2 months old).

Attestations of competence and evidence of formal qualifications.

Periods of carrying out the profession.

Certificate of professional qualification issued by the competent authority or body of the home Member State or Member State of origin.

Costs Explanation of this section

Stamp duty for the application: EUR 47.30 plus EUR 3.90 per sheet of attachments

For issuing the decision: stamp duties of EUR 83.60 and provincial administrative tax of EUR 15.00

Legal basis Explanation of this section

Sections 7 and 8 of the Tyrol Law on Recognition of EU Professional Qualifications (Tiroler EU-Berufs Qualifications-Anerkennungsgesetz), Provincial Law Gazette (LGBl.) No 86/2001, as amended.

Legal remedies

Appeals against the decision notice may be lodged before the Regional Administrative Court. The appeal must specify the contested decision and the authority that issued it. It must contain a request and set out the grounds on which the allegation of illegality is based. The appeal must be submitted in writing to the authority that issued the decision within 4 weeks of notification of this decision, and must contain information that makes it possible to assess its timeliness. The authority may issue a preliminary appeal decision. The appeal may be filed electronically: Beschwerde im Verwaltungsverfahren (Appeals in administrative proceedings).

If the administrative authority fails to make a decision within 6 months, you have the option of filing a complaint before the Regional Administrative Court regarding the delay. This must be filed with the defaulting authority. The complaint must specify that authority, set out a specific request and demonstrate that the authority’s time limit for making a decision has expired.
