The municipal council is responsible for appointing chimney sweeps. Each appointment is valid for 5 years. It may be extended for a further 5 years if no decision to appoint another chimney sweep is made within this period.

All chimney sweeps in the sweeping area must be given the opportunity to apply before a chimney sweep is appointed. If the sweeping area extends across the territory of several municipalities, the other municipalities in the sweeping area must also be consulted. The appointment of a chimney sweep must be announced through publication on the municipality’s official bulletin board for 2 weeks, as well as in any other customary manner in the locality. The appointment of a chimney sweep ends at the expiry of the chimney sweep’s term upon a timely decision on the appointment of another chimney sweep, or in the event of the termination of the chimney sweep’s licence to trade. The district administrative authority must immediately inform the municipalities in the sweeping area if the chimney sweep’s licence to trade is terminated. The municipality must appoint a new chimney sweep without delay. The owner of premises required to be cleaned, or the party otherwise entitled to use such premises, may transfer the chimney sweep’s duties to another chimney sweep by means of a contract. Operational combustion plants must be inspected (and cleaned, depending on the installation) by the chimney sweep unless self-cleaning is permitted or an alternative arrangement is in place. The frequency of chimney-sweeping appointments must meet the fire safety authority’s requirements arising from the annually defined heating periods. Where inspections, or inspections and cleaning, take place twice a year, the interval between chimney-sweeping appointments must not be much less than 4 months. Where inspections, or inspections and cleaning, take place three, four or five times a year, this interval must not be much less than 2 months. The chimney sweep must mechanically or chemically clean or burn off flues and exhaust tubes that cannot be cleaned by sweeping due to bends, insofar as their nature allows. However, burning off is only permitted if mechanical or chemical cleaning is impossible. Burning off is forbidden in twilight, at night, in strong winds and in very dry periods. Every 5 years, unless a fire inspection is carried out in the year concerned, the chimney sweep must inspect all installations required to be cleaned for their fire safety (the ‘main inspection’ [Hauptüberprüfung]), and must inform the authority immediately in writing if any defects are identified.
